Die Proteste waren in der Folge europaweit so massiv, dass die Kommission Änderungen an der Richtlinie vornehmen musste. Insbesondere verzichtete sie auf das sogenannte Herkunftslandprinzip, demzufolge Dienstleistungsfirmen berechtigt gewesen wären, ihre Dienste gemäß dem Recht ihres Herkunftslandes EU-weit anzubieten – was einen Unterbietungswettbewerb nationaler arbeitsrechtlicher Standards zur Folge gehabt hätte. Die Änderungen galten damals zu Recht als großer Erfolg der Protestbewegung. Seither ist die Bolkestein-Richtlinie weitgehend aus der politischen Öffentlichkeit verschwunden. Doch völlig zu Unrecht: Denn bis zum Ende dieses Jahres muss ihre Umsetzung in nationales Recht vollzogen sein. Und der Gesetzgeber ist seit 2005 keineswegs untätig geblieben. In any event, though, there’s trouble in River City, and the politicians have naturally decided that ’something must be done,’ lest the peasants grow dangerously restive. Whence cometh a good deal of talk about ‘more stimulus,’ although administration spokespersons such as Larry Summers are quick to distance themselves from this phraseology, if not from the substance it denotes.
